Hon'ble High Court issues Contempt of Court Notice for not complying with order to declare per student expenditure

Lucknow, 20 December 2023 : In Contempt Application (Civil) No. 3118 of 2023 [C/M Lucknow Asthetic Development Society Vs. Shri Deepak Kumar, Prin. Secy. Education, Lko. & Ors.)], contempt notice has been issued to Shri Deepak Kumar, Principal Secretary, Education, Lucknow for not complying order dated 26.08.2022 passed in Writ -C No. 15790 of 2019 [C/M Lucknow Education and Asthetic Development Society Vs. State of U.P. through Prin. Secy. Basic Education, Lucknow & Ors]. The Hon. High Court took notice that in spite of time granted to learned Standing Counsel for filing affidavit of compliance, till date the order dated 26.08.2022 has not been complied with.

In the aforesaid Contempt Application, vide order dated 15.12.2023, the Hon. High Court has issued direction for filing affidavit of compliance, failing which the Hon. Court may issue direction to the erring authorities for personal appearance.It is informed that the State Government is required to fix the reimbursement amount to all schools of Uttar Pardesh as per Section 12(2) of RTE Act for every calendar year. The State of U.P. has not declared it since 2013. In this regard a Writ Petition bearing Writ -C No. 15790 of 2019 was filed by the C/M Lucknow Education Asthetic Development Society, which was allowed by Hon. High Court vide order dated 26.08.2022, whereby direction was given by Hon. High Court to declare per pupil expenditure for every calendar year.
